MaybeReal – Terms of Use

These Terms of Use ("Terms") govern your use of the MaybeReal mobile application (the "App"), provided by 3DATA ("we", "us", "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Service description

MaybeReal allows you to upload images and apply AI-powered transformations such as enhancement, upscaling, colorization, restoration, and various filters or effects. The exact features may change over time.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use the App. By using the App, you represent that you meet this requirement and that you have the legal capacity to agree to these Terms.

3. Account and security

• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately if you suspect any unauthorized access or use of your account at maybereal.app@gmail.com.

4. Your content and license

4.1 Your content

"Content" means the images and any other material you upload or generate in the App.

• You remain the owner of your Content.
• You are solely responsible for your Content and for ensuring you have all necessary rights to use it in the App.

4.2 License you grant to us

By uploading Content to the App, you grant us a limited, worldwide, non-exclusive, royalty-free license to:

• Host, store, process, and display your Content as necessary to provide the App's features to you.
• Send your Content to external AI service providers in order to generate the requested outputs.

We do not claim ownership of your Content and we do not use your Content for our own marketing without your explicit consent.

5. Acceptable use

You agree not to use the App to:

• Upload any Content that is illegal, harmful, abusive, harassing, defamatory, or hateful.
• Upload Content that violates the rights of others (including intellectual property rights, privacy, or publicity rights).
• Create or distribute sexually explicit content involving minors or any other illegal content.
• Reverse engineer, decompile, or attempt to extract the source code of the App.
• Attempt to bypass security measures or abuse the service (e.g. automated scraping, spam, or excessive load).

We may suspend or terminate your access if you violate these rules.

6. Subscriptions and In-App Purchases

6.1 Auto-Renewable Subscriptions

The App offers the following auto-renewable weekly subscription options:

• MaybeReal Pro – 3,000 credits per week, renews automatically every 7 days. Includes a 3-day free trial with 300 credits for new subscribers.
• MaybeReal Advanced – 7,000 credits per week, renews automatically every 7 days
• MaybeReal Unlimited – Unlimited usage per week (up to 100,000 credits), renews automatically every 7 days

Subscription prices are displayed in the App before purchase and may vary by region.

Subscription credits are granted for the current billing period only. At each renewal, your subscription credit balance is reset to the plan's weekly amount: subscription credits are not cumulative and do not carry over from one period to the next, regardless of how many you had left. Any unused subscription credits are forfeited at renewal.

6.2 Payment and Billing

• Payment will be charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the cost of the chosen subscription.
• Subscription credits are not cumulative or transferable between billing periods. Unused subscription credits do not roll over and are reset at each renewal.
• This non-rollover rule applies only to subscription credits. Credits obtained from one-time credit packs or from in-app rewards are separate, do not expire, and are not reset at renewal (see Section 6.5).

6.3 Managing and Canceling Subscriptions

• You can manage or cancel your subscription at any time by going to your device's Settings → [Your Name] → Subscriptions.
• Cancellation takes effect at the end of the current billing period. You will retain access to premium features until then.
• No refunds will be provided for the unused portion of any subscription period.

6.4 Free Trials

MaybeReal Pro includes a 3-day free trial with 300 credits for new subscribers.

• The free trial automatically converts to a paid weekly subscription at the end of the 3-day trial period unless you cancel at least 24 hours before the trial ends.
• Any unused portion of a free trial will be forfeited when you purchase a subscription.
• Free trials are available only once per Apple ID.
• You can cancel at any time during the trial by going to Settings → [Your Name] → Subscriptions.

6.5 Credit Packs (One-Time Purchases)

The App offers the following one-time credit packs:

• 5,000 Credits Pack
• 15,000 Credits Pack
• 50,000 Credits Pack

Credit packs are consumable, non-refundable purchases. Credits do not expire but cannot be transferred or refunded. Prices are displayed in the App before purchase and may vary by region.

7. Third-party services

The App uses third-party services such as Supabase (backend, database, storage), RevenueCat (subscription management), and external AI service providers (Fal.ai, Replicate, ByteDance) for image processing. Your use of the App may therefore be subject to their terms and policies as well.

8. Intellectual property

The App, including its design, interface, features, and underlying software, is owned by 3DATA or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, in accordance with these Terms.

9. Disclaimer of warranties

The App is provided on an "as is" and "as available" basis. We do not guarantee that the App will be error-free, uninterrupted, or that it will meet all of your expectations. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the maximum extent permitted by law, 3DATA will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenues, arising out of or related to your use of the App.

11. Termination

We may suspend or terminate your access to the App at any time if we reasonably believe that you have violated these Terms or that your use may cause harm to us, other users, or third parties. You may stop using the App and delete it from your device at any time.

12. Changes to the Terms

We may update these Terms from time to time. If we make material changes, we will notify you within the App or by other reasonable means. Your continued use of the App after the changes become effective means you accept the new Terms.

13. Governing law

These Terms are governed by the laws of France. Any disputes shall be resolved in the courts of France.
